LMMS kicker made into an VST

I was wondering if this is known by the LMMS devs ?

Since LMMS is opensoure there is probably not much they can do ?

LMMS is open-source, but is licenced under GPL2.
Anyone may use LMMS code, but they are obligated to not only have LMMS-header with the GPL2 statement, but! Also their code must be open-source, and must be under GPL2
If the coder that has made this VST, does not release his code, and not publish under GPL2, it is a violation of the GPL2, afaiu GPL2
